This legal agreement constitutes an electronic record in accordance with the
Information Technology Act, 2000, and the rules thereunder as applicable, and the
amended provisions pertaining to electronic records in various statutes as amended by the
Information Technology Act, 2000. It is generated by a computer system and does not
require any physical or digital signatures.

This document is published in compliance with Rule 3(1) of the
Information Technology (Intermediaries Guidelines) Rules, 2011, and
Rule 4 of the Information Technology (Reasonable Security Practices and
Procedures and Sensitive Personal Data or Information) Rules, 2011 of the Information
Technology Act, 2000, read with the Digital Personal Data Protection Act, 2023. These
rules mandate the publication of the privacy policy and practices for the collection, use and disclosure
of personal data through any functional application or website.

The “Gujarat Taxi” platform (the “Platform”), comprising the
Gujarat Taxi mobile applications for Customers and Drivers and the website
https://gujarattaxis.com/, is owned and operated by
OBAC Technology Private Limited (hereinafter referred to as “We”,
“Our”, “Us” or the “Company”), operating under the brand name
“Gujarat Taxi”. We are steadily committed to protecting your privacy with
regard to the invaluable information that you may share while accessing or using the Platform. This
Privacy Policy contains information about the Gujarat Taxi Platform.

For the purpose of this Privacy Policy (“Privacy Policy”), wherever the context so requires,
“We”, “Our” and “Us” shall mean and refer to the Company.
“You”, “Your”, “Yourself”, “User”,
“Customer” or “Driver” shall mean and refer to natural and legal persons who use
the Platform and who are competent to enter into binding contracts as per Indian law. “Third
Parties” refers to any application, platform, person or entity apart from the Users and the Company.

To provide you with uninterrupted use of the Platform, We may collect and, in some circumstances,
disclose information about you with your permission. To ensure better protection of your privacy, We
provide this notice explaining Our information practices and the choices you can make about the way your
information is collected and used.
This Privacy Policy is designed to comply with applicable Indian data-protection law, including the
Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, and, where applicable, the
General Data Protection Regulation (GDPR). If you do not agree with any term of this Privacy Policy,
particularly regarding the collection or use of your information, please refrain from using or accessing the
Platform. For any questions or concerns about this Privacy Policy, please contact our support desk at

Any capitalised words used herein but not defined shall be interpreted according to the definitions provided
under the Gujarat Taxi Terms and Conditions. The headings used in this document are for organisational
purposes only and shall not be used to interpret the provisions contained herein.
1. General Terms

The Platform is a Software-as-a-Service (SaaS) tool that connects passengers (“Customers”)
with independent drivers (“Drivers”) for transportation services. The Platform enables lead
generation and ride coordination; the actual ride is provided by the Driver directly to the Customer. We
do not own vehicles and do not employ Drivers.

The use of the Platform is governed by this Privacy Policy together with the Gujarat Taxi Terms and
Conditions and any modifications made thereto by Us from time to time at Our sole discretion. If you
continue to access and use the Platform, you agree to be bound by this Privacy Policy.

This Privacy Policy and the Terms and Conditions are co-terminus in nature; expiry or termination of one
will lead to termination of the other.

We reserve the right to amend or modify this Privacy Policy without prior individual notice to you. Any
such amendment takes effect immediately upon being posted on the Platform. Your continued use of the
Platform after such posting signifies your acceptance of the changes.
2. Registration and the Information You Provide
The Platform allows you to register by providing certain information. Depending on whether you use the
Platform as a Customer or a Driver, the information collected includes:
2.1 Customers
- Name, mobile number, email address, and (where provided) postal code and city;
- Profile photo (optional);
- Pickup and drop-off addresses, saved places and ride history;
- Payment-related information processed through a third-party payment gateway (see Section 6);
- Ratings, feedback, support tickets and communications you send to Us.
2.2 Drivers / Captains
To maintain the authenticity of users in the community and to reduce fraud and scams, We also collect
“Driver Information”, which includes your KYC details, mobile number, documents and other
information submitted during onboarding, such as:
- Valid driving licence and driving-licence number;
- Aadhaar number and PAN;
- Vehicle registration certificate (RC), commercial permit (if applicable);
- Valid insurance certificate, pollution (PUC) certificate and fitness certificate;
- Bank account / UPI details for payout of ride earnings;
- Vehicle details, trip logs, acceptance and cancellation history, ratings and performance metrics;
- Real-time and background location while you are online / on a trip (see Section 5).
You must provide only true and accurate information and keep it up to date. We are not responsible for
verifying the accuracy of the information you submit, and We may reject a registration or suspend an account
if the information is found to be false, inaccurate, incomplete or misleading.
3. How Information Is Collected

Before or at the time of collecting personal information, We will identify the purposes for which the
information is being collected. If the purpose is not identified to you, you have the right to request Us
to explain the purpose of collection.

We collect and use your personal information solely to fulfil the purposes specified by Us, within the
scope of your consent or as required by law. We retain personal information only for as long as necessary
for those purposes or as required under applicable law. Information is collected by lawful and fair means
and with your knowledge and consent.

Personal data collected is relevant to the purposes for which it is to be used and, to the extent
necessary for those purposes, is kept accurate, complete and up to date.

We collect information: (a) directly from you when you register, book or complete a ride, contact
support, or update your profile; (b) automatically from your device when you use the Platform (device
model, operating system, app version, IP address, mobile network, crash logs, and diagnostic data); and
(c) from Drivers/Customers you interact with, and from third parties such as payment gateways,
verification agencies and mapping providers.
4. How We Use Your Information
- To create and manage your account and verify your identity and eligibility;
- To connect Customers with Drivers, allocate ride requests and enable navigation and trip tracking;
- To calculate fares, process payments, commissions, payouts and applicable taxes;
- To provide customer support and resolve disputes, tickets and safety concerns;
- To send you service-related communications, receipts, trip updates and important notices;
- To operate ratings, detect and prevent fraud, unsafe conduct, misuse and security incidents;
- For analytics, research and to improve the safety, features and performance of the Platform;
- To comply with legal, regulatory, tax and law-enforcement requirements;
- With your separate consent, to send marketing and promotional messages, which you may opt out of at any
time.
5. Location Information and Location Permissions
Location data is essential to Gujarat Taxi. A ride-hailing service cannot match you with a
nearby Driver, navigate a trip, calculate an accurate fare, or keep a trip safe without access to device
location. This section explains exactly what location data We collect, when, why, and how you can control it.

5.2 What We do and do not do with location data
- Background location for Drivers is collected only while you are logged in and set to
online/available or are on a trip. When you go offline or log out, background location
collection stops.
- Customer background/precise location is used only during an active trip and is not
tracked when you have no ongoing ride.
- Location data is used to operate and improve the ride service, for safety and fraud prevention, for
support and dispute resolution, and to meet legal obligations.
- We do not sell your location data. We do not use background location for
advertising.
- Location data is shared only as described in Section 7 (e.g. the matched Driver and Customer see each
other’s relevant location during a trip; mapping/navigation providers process location to render
maps and routes; law-enforcement or regulators where legally required).
5.3 Your control over location
- Location permissions are requested with a clear in-app prompt that explains why the permission is needed
before the system dialog appears. Granting “allow all the time” is your choice.
- You can change or revoke location permissions at any time from your device settings
(Settings → Apps → Gujarat Taxi → Permissions → Location on Android, or
Settings → Gujarat Taxi → Location on iOS), or turn off device location services
entirely.

Effect of denying or limiting location access: core features will not work. Customers
will not be able to set an accurate pickup or be matched to nearby Drivers; Drivers will not receive ride
requests, navigation, or be able to go online. Denying background location for Drivers means ride
requests and trip tracking will not function reliably when the app is not on screen.
6. Payment Gateway
For payments made on the Platform, you will be redirected to a third-party payment gateway with which We have
an agreement. The payment gateway may seek additional information from you to process the payment and may levy
applicable payment-gateway charges. Supported instruments may include debit card, credit card, net banking,
UPI and wallet options. All payment-related aspects are governed by the concerned payment gateway’s
terms and policies. We do not store full card numbers or CVV on Our servers.
For carpool / shared rides, ride fares are made available within 3 hours after the trip ends. If you have a
question or a dispute regarding a fare, please raise a support ticket through the app’s ticket module
within 90 minutes of trip completion.
7. Sharing and Disclosure of Information
We share personal information only as follows:
- Between matched Customers and Drivers: name, masked or in-app contact, vehicle details,
photo, rating and relevant real-time location for the purpose of completing a ride.
- Service providers and processors: mapping and navigation providers, cloud hosting,
communications (SMS / call-masking / WhatsApp), payment gateways, KYC and background-verification
agencies, and analytics providers, who are bound to use the data only for the services they provide to
Us.
- Government authorities, regulators, courts and law-enforcement: where required by
applicable law, legal process, or a valid governmental request, or to protect rights, safety and
property.
- Corporate transactions: in connection with a merger, acquisition, financing or sale of
assets, subject to this Privacy Policy.
- With your consent: for any other purpose disclosed to you at the time of collection.
8. Data Retention
We retain personal information for as long as your account is active and thereafter for the period necessary
to comply with legal, tax, accounting, dispute-resolution, safety and regulatory obligations, after which it
is deleted or anonymised. Trip records and transaction records may be retained for longer where required by
law.
9. Data Security
We adopt reasonable security practices and procedures — including access controls, encryption in
transit, and internal review — to protect your information against unauthorised access, alteration,
disclosure or destruction. However, no method of transmission over the internet or method of electronic
storage is fully secure; you are responsible for keeping your account credentials confidential and for
notifying Us immediately of any unauthorised use of your account.
10. Your Rights
Subject to applicable law and exemptions, you have the right to:
- Request a copy of the personal data We hold about you;
- Request correction of inaccurate or out-of-date personal data;
- Withdraw consent to processing at any time (this may limit or prevent your use of the Platform);
- Request deletion of your account and personal data, subject to legal retention requirements;
- Object to or restrict certain processing, and opt out of marketing communications;
- Lodge a complaint with the relevant supervisory or data-protection authority.

11. Cookies and Similar Technologies
Our website may use strictly necessary, analytical/performance and functionality cookies to operate the site,
remember your preferences and understand usage. Third parties (for example, analytics providers) may also set
cookies over which We have no control. You can block cookies through your browser settings, but some parts of
the website may then not function properly.
12. Third-Party Links and Services
The Platform may contain links to or integrations with third-party websites and services. This Privacy Policy
does not apply to those third parties, and We are not responsible for their content or privacy practices. We
encourage you to read the privacy policies of every third-party service you use.
13. Children’s Privacy
The Platform is not intended for persons under 18 years of age, and Drivers must be at least 18 years old with
a valid driving licence. We do not knowingly collect personal data from children. If you believe a child has
provided us personal data, contact support@gujarattaxis.com and
We will delete it.
14. Communication
By using the Platform and providing your contact information, you agree and consent to receive calls, SMS,
WhatsApp messages, emails and push notifications from Us and Our representatives relating to your account,
bookings, trips, safety and support. You may report any discrepancy relating to the Platform or its content
to Our support desk, and We will take necessary action after investigation. The time to resolve an issue
depends on the time taken for investigation.
15. Content
All text, graphics, user interfaces, photographs, trademarks, logos, brand names, descriptions and artwork
(collectively, “Content”) is generated or provided by Us, Our users or third parties. Content
generated by users is not owned by Us, and We make no guarantee regarding its accuracy, integrity or
genuineness. Content on the Platform is subject to copyright and may not be reused by you or a third party
without prior written consent from Us and the copyright owner. You are granted a personal, non-exclusive,
non-transferable, revocable, limited privilege to access the Content on the Platform.
16. Indemnity
You agree to indemnify, defend and hold harmless the Company and its directors, officers, employees, agents
and affiliates from and against any losses, liabilities, claims, damages, demands, costs and expenses
(including legal fees) that arise out of or result from: (a) your use of the Platform; (b) your violation of
this Privacy Policy or the Terms and Conditions; (c) your violation of the rights of another; (d) your
provision of, or failure to provide, ride services; or (e) your improper conduct in connection with the
Platform. In no event shall the Company be liable for any special, incidental, indirect, consequential or
punitive damages, including those resulting from loss of use, data or profits.
17. Limitation of Liability

We are not responsible for any consequences arising out of: connectivity errors associated with your
internet connection (slow connectivity, no connectivity, server failure); incorrect information or data
entered by you or deletion of data; undue delay or inability to communicate through email; any deficiency
or defect in services managed by Us; or a failure in the functioning of any other service provided by Us.

The Platform accepts no liability for any errors or omissions, or for any damage caused to you, your
belongings or any third party, resulting from the use or misuse of the Platform or any service availed
through it. The Platform and any Content is provided on an “as is” and “as
available” basis without guarantees, conditions or warranties as to accuracy, suitability,
completeness or reliability.

To the fullest extent permitted by law, the Company’s aggregate liability for any claim arising out
of or relating to the Platform or a ride is limited to the value of the relevant ride fare. Your sole and
exclusive remedy for any dispute with Us is to stop using the Platform.
18. Term, Suspension and Termination
- This Privacy Policy remains in full force and effect while you access and use the Platform.
- You may stop using the Platform at any time.

We may, at Our sole discretion and without prior notice, limit, suspend or terminate your access to the
Platform (in whole or in part) if: you breach this Privacy Policy or the Terms and Conditions; you
provide wrong, inaccurate, incomplete or incorrect information; your conduct may cause harm, damage or
loss to other users or to Us; or your conduct harms the Company’s business interests or reputation.
- Such suspension or termination does not limit any other action We may take against you.
- On termination, you must stop using the Platform immediately.
19. Intellectual Property Rights
The Platform, its design, content, trademarks, service marks, logos, domain names and other distinctive brand
features are the property of the Company or the respective owner. Nothing in this Privacy Policy gives you a
right to use any of them except as expressly permitted. You must not copy, modify, reverse engineer,
distribute, publish or create derivative works from any part of the Platform without Our prior written
permission. This section survives termination or expiry of this Privacy Policy and the Terms and Conditions.
20. Disclaimer of Warranties and Liabilities
- You access and use the Platform at your sole risk and using your own prudent judgment.
- Any information, resources, recommendations or activities obtained from the Platform, written or oral, do
not create any warranty, and We disclaim all liabilities resulting from them.
- We do not guarantee that the features and content of the Platform will be uninterrupted or error-free, or
that the Platform or its servers are free of viruses or other harmful components.
- This section survives termination or expiry of this Privacy Policy and the Terms and Conditions.
21. Force Majeure
We will not be liable for any delay or failure to perform Our obligations where such delay or failure is due
to causes beyond Our reasonable control or without Our fault or negligence, including acts of war, acts of
God, earthquake, flood, riot, fire, sabotage, labour shortage or dispute, internet interruption, technical
failure, breakage of sea cable, hacking, piracy, or unauthorised or illegal access to Our systems.
22. Governing Law, Dispute Resolution and Jurisdiction
This Privacy Policy, the Terms and Conditions and any other agreements between the parties are governed by the
laws of India, and specifically by the laws applicable in the State of Gujarat. The formation,
interpretation and performance of this Privacy Policy and any disputes arising from it will first be sought to
be resolved amicably; failing which the dispute will be referred to arbitration by a sole arbitrator
appointed by Us under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be
Ahmedabad, Gujarat, and the proceedings shall be conducted in English. Subject to the arbitration agreement,
the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction. This section survives termination or
expiry of this Privacy Policy and the Terms and Conditions.
23. Miscellaneous
- Entire agreement: This Privacy Policy, read with the Terms and Conditions, forms the
complete and final understanding between the parties on its subject matter and supersedes all prior
communications and agreements.
- Waiver: Our failure to enforce any provision at any time does not waive Our right to
enforce it later.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions
remain in full force, and the invalid provision will be reformed to the minimum extent necessary to make
it enforceable while preserving the parties’ intent.
24. Amendments to This Policy
We may modify this Privacy Policy at any time at Our discretion. Updates will be posted on the Platform with a
revised “Last updated” date and take effect immediately upon posting. Your continued use of the
Platform after an update constitutes acceptance of the revised Privacy Policy.
25. Grievance Officer / Contact Us
If you have any questions, complaints or grievances regarding this Privacy Policy, the practices of the
Platform, or your dealings with the Platform, you may contact Us. We will acknowledge your complaint within 24
hours and endeavour to resolve it within the timelines prescribed under applicable law.
By using Gujarat Taxi services, you acknowledge that you have read, understood and agree to this Privacy
Policy.
